3. Products & Orders

Product Descriptions: We strive to display accurate descriptions, photos, and compatibility information for all Commodore parts. However, we do not warrant that descriptions, colours, or specifications are error‑free. If a product is not as described, your sole remedy is to return it under our Returns Policy.

Order Acceptance: After you place an order, you will receive an automated confirmation email. This does not constitute acceptance of your order. We reserve the right to accept or decline any order for any reason (e.g., product unavailability, pricing error, suspected fraud). If we cancel your order after payment, we will issue a full refund.

Pricing: All prices are in Australian Dollars (AUD) and include GST unless stated otherwise. We reserve the right to change prices without notice, but prices quoted at checkout are final.

4. Shipping & Delivery

Our shipping terms are detailed in our Shipping Policy (available separately). By placing an order, you agree to our shipping terms, including dispatch times, carrier selection, and delivery estimates. Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for carrier delays.

5. Payments & Taxes

We accept the payment methods listed in our Payment Policy. You warrant that you have the legal right to use the payment method you select. All payments are processed through third‑party gateways; we do not store full card details.

All sales are subject to Australian GST (10%) where applicable. You are responsible for any bank fees, currency conversion costs, or other charges imposed by your payment provider.

6. Returns, Refunds & Warranty

Consumer Guarantees: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Our Warranty: In addition to your ACL rights, we provide a 6‑month warranty on all used parts (except consumables like filters, gaskets, and brake pads). Engines and gearboxes carry a 12‑month warranty. Warranty covers defects in materials or workmanship under normal use. It does not cover damage from improper installation, modification, accident, or neglect.

Returns Process: To initiate a return, contact us within 30 days of receipt. You may need to provide photos or video of the issue. Approved returns must be sent back in original packaging. Return shipping costs are your responsibility unless the item is faulty or we made an error.

7. Limitation of Liability

To the maximum extent permitted by law, Commodore Wreckers Gold Coast shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or vehicle downtime arising from the use or inability to use any part purchased from us. Our total liability for any claim arising from these terms or your purchase shall not exceed the amount you paid for the specific part(s) giving rise to the claim.

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded or limited under Australian Consumer Law. For major failures, you are entitled to a full refund or replacement, plus compensation for foreseeable loss. For minor failures, we may choose to repair or replace the part.

8. Installation & Use

All Commodore spare parts must be installed by a qualified mechanic. We accept no liability for damage, injury, or vehicle failure resulting from improper installation, modification, or misuse of any part. It is your responsibility to ensure that the part is compatible with your vehicle. If you are unsure, contact us before ordering with your VIN.

9. Intellectual Property

All content on our Site – including text, images, logos, graphics, and software – is the property of Commodore Wreckers Gold Coast or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent. Holden and Commodore are registered trademarks of General Motors (or successor). We are an independent parts supplier, not affiliated with or endorsed by GM.

11. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of Queensland, Australia and the Commonwealth of Australia. Any dispute arising out of or relating to these terms or your purchase shall first be attempted to be resolved through good‑faith negotiation. If unresolved, the dispute shall be submitted to mediation in the Gold Coast region before any court action. Each party shall bear its own costs of mediation. If mediation fails, either party may commence proceedings in the courts of Queensland.

12. Prohibited Conduct

When using our Site, you agree not to:
